These Buy It Now Terms (“Terms”) govern an immediate purchase made through the private catalog operated by Aurora Gold and Silver, LLC (“Aurora,” “we,” or “us”). “Customer” and “you” mean the person responsible for the authenticated account used to confirm the purchase.

1. Scope and Electronic Acceptance

These Terms apply only to the Buy It Now catalog. They supplement Aurora’s Privacy Policy, the information displayed in the listing, and any separately applicable payment or shipping terms. If these Terms conflict with general seller or refining terms on DavidSouri.com, these Terms control the Buy It Now purchase.

Before an order is created, the review window identifies the item, quantity, server-confirmed unit price, total, price basis, payment window, tax result, and governing Terms version. Selecting the labeled Confirm binding purchase button is your electronic signature and acceptance of the displayed purchase. Aurora records the authenticated account, quote, listing revision, quantity, price snapshot, Terms version, and server acceptance time.

2. Eligibility and Account Responsibility

You may use Buy It Now only through an eligible non-staff customer account that Aurora has approved for private-auction bidding or the sell pipeline and that remains eligible to purchase. You must be at least eighteen (18) years old and maintain accurate contact and eligible physical United States shipping-address information.

You are responsible for activity through your authenticated account. A later purchasing restriction prevents new purchases and new auction bids but does not erase an existing order or payment obligation. A purchasing restriction does not by itself prevent you from selling eligible property to Aurora.

3. Listings, Quantity, and Condition

Each listing describes bullion or coins then available for immediate purchase. The title, description, photographs, stated metal, pure weight, quantity, grade, condition, and other expressly stated facts form the listing description. Photographs may not show every mark, surface detail, or color difference.

The catalog’s available quantity may change before confirmation. Selecting a quantity or receiving a quote does not reserve inventory. Review the complete listing and ask questions before confirming. Purchases are final except for a material difference from the listing description, verified shipping loss or damage, Aurora’s written agreement, or a right applicable law does not permit the parties to waive.

4. Pricing and Server Quotes

Catalog prices are based on Aurora’s applicable dealer ask for the listing’s pricing metal, adjusted by the listing premium or discount. The adjustment may be a percentage of the item’s pure-metal value, a dollar amount per pure troy ounce, or a flat dollar amount per unit. The listing’s declared pure weight controls weight-based pricing.

While the market is open, a binding quote requires a fresh trusted live price. While the market is closed, Aurora may use its latest trusted official session-close lock, including a holiday or early-close lock. If the required fresh price or trusted lock is unavailable, the system refuses a binding quote rather than estimating.

A catalog price is informational until Aurora’s server issues a short-lived quote. The review window displays the binding unit price and total. A quote does not reserve inventory, may expire, and may be rejected if the listing, account, destination, market basis, tax decision, or governing Terms changes before acceptance.

5. Binding Confirmation and Inventory

An order is created only when Aurora’s server accepts and records the confirmation. At that moment, the purchase is binding, the accepted quantity is removed from sale, and the displayed price is frozen for that order. Later market movement or listing edits do not change it.

Safe retries of the same unchanged confirmation use its protected request identifier and do not create a duplicate order. If the browser loses the response, the purchase screen may check or retry that exact request. Do not begin a different confirmation until its status is resolved.

6. Payment and Nonpayment

Payment is due within exactly twenty-four (24) hours after the server accepts the order unless Aurora extends the deadline in writing or through the account record. Payment is complete only after Aurora verifies cleared funds. Aurora’s payment record may use the actual time funds were received even if staff match or enter them later.

An unpaid order becomes overdue at its deadline but is not automatically canceled. Aurora reviews overdue orders and may extend the deadline, cancel and return the quantity to sale, restrict future purchasing and auction bidding, or take another reasonable action. Only a staff cancellation expressly recorded as nonpayment counts as a nonpayment incident. Three such incidents may make an account eligible for a staff-imposed purchasing restriction; no restriction is automatic.

7. Tax-Exempt Checkout

This version permits checkout only when Aurora affirmatively recognizes the transaction as tax-exempt under its then-current rules. Product type alone does not guarantee exemption. The server evaluates the listing and the customer’s current destination before creating the order. An unknown, unavailable, or non-exempt result is refused, and Aurora does not add sales tax to the order after binding confirmation.

The tax determination is recorded with the confirmed purchase and destination. A later destination change may require staff review and may prevent shipment if the recorded exemption no longer applies.

8. Shipping and Build-A-Box

Shipping is managed at the box or shipment level and is not a separate charge on the catalog listing unless expressly displayed. You must provide an accurate eligible physical address and comply with carrier, identification, signature, pickup, and delivery requirements.

An eligible customer-created Buy It Now order may enter Build-A-Box immediately while unpaid. It cannot be sealed or shipped until fully paid, and it does not begin the 45-day holding period until payment is verified. A nonpayment cancellation removes the purchase from the box. Several separately confirmed orders may share one later payment and shipment when Aurora’s payment and box records permit it.

9. Errors, Cancellations, and Liability

Aurora may pause quoting or checkout when pricing, inventory, tax, account, security, or data-integrity information cannot be trusted. Aurora may correct or withdraw an unpurchased listing. If a material description error, duplicate inventory commitment, suspected fraud, legal issue, or technical defect affected a confirmed order, Aurora may cancel or correct the affected transaction after review and return any applicable payment.

To the fullest extent permitted by law, Aurora is not liable for indirect, incidental, special, consequential, or lost-opportunity damages arising from an expired or unaccepted quote, price movement, unavailable inventory, device or network failure, delayed refresh, service interruption, or staff-reviewed cancellation.

10. Disputes, Versioning, and Contact

Contact Aurora promptly with the listing or order number and supporting information if you dispute a description, price, payment, cancellation, or shipment. These Terms are governed by Illinois law, and any legal action must be brought in the state or federal courts located in Kane County, Illinois.

This page is the immutable record of version buy-now-v1. The Terms version recorded with a confirmed order governs that order. Aurora may publish a later version for later confirmations but will not retroactively apply it to an order accepted under this version.
